The purpose of these general conditions of sale is to define the rights and obligations of our company and its customers in the exclusive context of the online sale of items offered by our website www.espinosa.fr
Online sales on the site www.espinosa.frAre subject to the present general terms and conditions of sale, and any order placed by the buyer implies his acceptance of the content of the provisions below.

The Shop reserves the right to adapt or modify these terms and conditions of sale at any time.
The items offered for sale on The Boutique are presented and detailed in such a way that all consumers are able to know the essential characteristics of the products they wish to purchase (article L 111-1 of the French Consumer Code).
ESPINOSA cannot be held responsible for any claims resulting from assembly or use that does not comply with the product specifications, assembly or use of the product with appliances for which it is not specifically intended, assembly not carried out by a qualified and certified professional, and any parts requiring the opening of the gas circuit as well as parts requiring the opening of a product operating on electricity.
 
 

2. Rates :

Prices are given in euros and exclude shipping costs, all taxes included.
In accordance with current legislation, the prices of all our products are subject to theT.V.A. french (20.0%) for all products sold in the European Union.
Any item invoiced outside the European Union will be sent with a customs document, and will be subject to local taxes and customs duties in force in the country chosen for delivery.
All customs and import taxes are due as soon as the goods reach their destination country. Please contact your local customs office for further details.
 
Some products on this site are subject to an environmental contribution in the form of a tax (ECO TAXE, also known as Eco participation and WEEE), to encourage their recycling.
The amount of the environmental contribution applicable to each product is set by the eco-organization in charge of recycling. This amount depends mainly on the product category to which the equipment belongs. Other criteria for assessing the volume of materials to be recycled are also taken into account (the weight of the product, the capacity of a refrigerator, the diagonal measurement of a TV screen for example, the materials used, its weight...).
The prices of the products concerned include this eco-tax.
The exact amount of this contribution is available on request via the contact form and automatically detailed on the purchase invoice for the products concerned.

The boutique reserves the right to revise its prices at any time, but undertakes to apply the prices in force at the time the order is placed, subject to availability at that time.


3. Postage and packing :

The shipping method and costs are calculated according to the destination zone of the order.
Any promotional sale displaying the words "free delivery" or "free shipping" is only intended for shipments within mainland France, excluding DOM TOM and Corsica.
Any order with free shipping outside this delivery zone may be subject to cancellation of the sale or to a shipping proposal with additional costs to be borne by the customer. In the event of refusal, the customer will be reimbursed the full amount of the order.


4. Regulations :

The goods ordered are payable in cash and without discount, the method of payment is at the buyer's choice among those proposed by The Boutique :

    Payments are secure and made via Paypal or ONEY, depending on your choice. Credit card details are encrypted using SSL (Secure Socket Layer, SHA 256) protocol, and are never transmitted unencrypted over the network.

  • Check(The customer has 7 days in which to send payment, after which time the order will be cancelled). Our company reserves the right to ask for proof of identity in the name of the bearer of the cheque in order to confirm its validity.

  • Bank transfer(The information required for the transaction is communicated when the payment method is validated.)
    The order will be processed as soon as the transaction has been confirmed by the bank.
    Additional fees may be charged after the transaction, depending on your banking institution (mainly foreign banks).

How it works : Payment in 3 or 4 instalments by credit card allows you to pay for your order on our merchant site in the following way:
- a mandatory deposit, debited on the day of confirmation of shipment of your order, corresponding to one third or one quarter of the order, to which are added charges corresponding to 1.45% of the total amount of the order for a 3-time payment and 2.2% for a 4-time payment (up to a maximum of €15 for a 3-time payment and €30 for a 4-time payment) ;

5. Order shipment - Delivery :

"All orders placed before 2pm are dispatched the same day!"
(while stocks last)
Orders are dispatched according to your choice at the time of ordering, by La Poste in tracked mode (Colissimo or Lettre suivie depending on volume), Transporteur (GEODIS FRANCE EXPRESS), Chronopost for parcels under 30 Kg. All orders over this weight will be systematically sent by carrier (GEODIS FRANCE EXPRESS).

All orders are processed daily from Monday to Friday inclusive (except public holidays).
Orders are dispatched on receipt of payment.
All orders placed before 2:00 pm are dispatched the same day, subject to stock availability, and for all shipments sent by Chronopost Colissimo or Lettre MAX. Orders sent by GEODIS FRANCE EXPRESS will be dispatched the next day (D+1).
Please note that the Chronopost express carrier reserves the right to drop off your parcel at a relay point on the day of delivery if delivery to the address given in your order is not possible.
No compensation will be possible in the event of redirection and availability of your package on the scheduled delivery date.

Delivery times vary according to the time taken by La Poste to deliver the mail. Generally, for metropolitan France, delivery takes between 48 and 72 hours from the date of dispatch (valid for COLISSIMO, La Poste, Lettre suivie). For Europe and French overseas departments and territories, please allow around one week for delivery.
For shipments made by the GEODIS FRANCE EXPRESS carrier, please allow 1 to 2 working days.
For Chronopost shipments, your order will be delivered the next day (provided you have registered your order before 2pm the day before), and only from Monday to Thursday. Friday shipments do not guarantee Saturday delivery. Except on express request by email, at extra cost)

In all cases, we confirm the shipment dates by e-mail.
After the period of availability in a COLISSIMO collection point (10 days) or POINT RELAIS (14 days), the parcel is automatically returned to our premises. Any return of the goods to the addressee will be subject to new transport costs, failing which the order will be cancelled and reimbursed without the initial shipping costs.
Any complaint following the deterioration, spoliation or dispute of aquis will have to be formulated imperatively in the 3 working days following the reception to the deposit of the conveyor as well as to our services by mail recommended to the SARL ESPINOSA 43 boulevard Berthelot 34000 Montpellier, without which the recipient will not be able to in no case to make his right of retractation and/or request for compensation.
Article L133-3 of the French Commercial Code
Receipt of the transported goods extinguishes any action against the carrier for damage or partial lossif, within three days, not including public holidays, following the day of receipt, the consignee has not notified the haulage contractor, by extrajudicial act or by registered letter, of his reasoned protest.
If a request for expert appraisal is made within the above-mentioned timeframe in application ofarticle L. 133-4, this request is deemed to be a protest without the need to proceed as described in the first paragraph.
Any stipulations to the contrary are null and void. This last provision does not apply to international shipments.
In the event of an order not being claimed by the recipient, and after a period of 60 days without any response from the recipient, the company ESPINOSA reserves the right to cancel the customer's order and proceed with the reimbursement of the product(s) not received, excluding shipping costs.
IMPORTANT !
      On receipt of your order, check the goods with your delivery person.
It is your right to have him stay to unpack the goods and check that they are in good condition.
In the event of a problem, make a precise note of the discrepancy on the carrier's delivery note, and contact our services as soon as possible.

In the event of a dispute without a report, please go to the carrier's office within 24 hours of delivery, accompanied by a photo of the defect, a statement of honour (Click here), and fill in a report. For your dispute to be processed correctly, you must provide us with a copy of all these documents within 3 working days.


6. Return of an item (Satisfied or refunded, retraction...)

In accordance with article 121-16 of the French Consumer Code, the buyer has 14 days from receipt of the order to return the product purchased.
In the case of an order for several goods delivered separately, or in the case of an order for a good made up of multiple batches or parts whose delivery is staggered over a defined period, the time limit runs from receipt of the last good, batch or part.
Be careful !In the event of refusal of delivery or non-recovery of goods following withdrawal by the addressee, our services reserve the right to invoice the cost of returning the goods to our premises, up to the amount of the initial shipping costs.
 
You have 14 days to retract your order!
Provided the goods are in perfect condition and in their original, undamaged packaging.

*The right of withdrawal cannot be exercised for :
  • Products whose price depends on fluctuations in financial market rates.
  • Products made to the consumer's specifications or clearly personalized or which, due to their nature, cannot be reshipped or are likely to deteriorate or expire quickly (chemical products, electronic cards, etc.)
  • Products which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene (e.g. toilet seat).
  • Products which, after delivery and due to their nature, are inseparably mixed with other articles
  • Raw products, sold by the slice.
  • A volume order for the same item, the quantity of which required specific sourcing from the manufacturer. Example: order of 30 fans of the same reference.

Prior to any return, please contact ESPINOSA.fr customer service by email at info@espinosa.fr.

The sender is responsible for any costs relating to the return shipment. In the event of non-recovery of the parcel made available at a relay point within the allotted time, the automatic return of the parcel will be considered as a retraction for which we will deduct the return postage from the reimbursement of the initial order.
No COD shipments will be accepted by The Boutique.

In the event of an apparent defect upon unpacking, no refund/replacement will be processed without a prior inspection of your merchandise by the delivery person, and detailed on the delivery slip.
If this is not the case, you will be able to discuss the defect with the carrier within 24 hours of receipt.
To cancel your reception and assert your rights:
- for delivery by CHRONPOST and/or COLISSIMO, please go to your nearest post office with a photo of the defect, a sworn statement mentioning the facts and the carrier's tracking number, and fill in a report. For your claim to be processed correctly, you must send us a copy of all these documents within 48 hours by e-mail to info@espinosa.fr or by registered post to SARL ESPINOSA, 43 Bd Berthelot 34000 Montpellier.

For all orders outside mainland France:
Any return of goods from abroad or DOM TOM will only be accepted if the return is fully paid for by the buyer. In addition, the refund of the order can only be applied to the merchandise without taking into account shipping costs.
 
When the right of withdrawal is exercised, SARL ESPINOSA is obliged to reimburse the Customer for all sums paid for the goods purchased, including delivery costs up to a maximum of the most economical rate offered at the time of ordering, without unjustified delay and no later than fourteen (14) days from the date on which ESPINOSA is informed of the Customer's decision to withdraw.
ESPINOSA may defer the refund until the goods have been recovered or until the Customer has provided proof of shipment of the goods. The refund will be made by ESPINOSA using the same method of payment as that used by the Customer for the initial transaction, or by cheque if the initial method of payment does not allow this. In addition to the aforementioned cases, ESPINOSA reserves the right to hold the Customer liable in the event of:
- deterioration of goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of these goods
- for any damage caused to the product from the time of receipt of the goods by the Customer until their return to the point of return at ESPINOSA.
- incomplete return of the goods and accessories without packaging, instructions or documentation
In such cases, the amount that may be withheld from the refund of the product or requested from the customer may amount to:
- 100% of the price of the good in the event of a damaged product
- 50% of the price of the item concerned in the case of a used product
- 50% of the price of the item if accessories are not returned
- 10% of the price of the goods if the instructions or documentation are not returned, or if the packaging is damaged.


7. Reservation of title :

In accordance with French law no. 80.335 of May 12, 1980, The Boutique reserves ownership of the goods delivered until full payment has been received.


8. Information technology and civil liberties :

The information requested from the customer is necessary for the processing and execution of the order. Data files remain internal to La Boutique ESPINOSA, and any person has the right to access and rectify information concerning him or her, in accordance with the French Data Protection Act of January 6, 1978.
 


9. Disputes :

These terms and conditions of sale are governed by French law.
Any dispute relating to the interpretation or execution of orders will be examined with the greatest care and will be the subject of an immediate amicable proposal. In the event of an unresolved dispute between La Boutique ESPINOSA and the purchaser, the latter is free to choose the competent commercial court in the matter between that corresponding to the domiciliation of his delivery, his domicile, or that of Montpellier in the Hérault (34000) where the registered office of the company ESPINOSA is located.
 
 

10. Warranty:

Each product sold on ESPINOSA.fr has a minimum legal warranty of 2 years.
A 6-month legal warranty applies to all parts subject to wear and tear only.
Details of guarantees specific to each item are available on request, Monday to Friday, 8am to 6pm.
Any product with a warranty of more than 2 years is the sole responsibility of the manufacturer. After the 2-year minimum warranty period, the purchaser is fully responsible for all transport costs incurred by our service department for the return of the product.

Legal warranties
When acting under the legal warranty of conformity, which applies independently of any contractual warranty that may have been granted, the consumer:
- has two years from the date of delivery of the goods to take action;
- may choose between repairing or replacing the good, subject to the cost conditions set out in article L. 211-9 of the French Consumer Code;
- is exempt from proving the existence of the lack of conformity of the good during the six months following the delivery of the good. This period is extended to twenty-four months from March 18, 2016, except for second-hand goods.
All sales, whatever the nature of the product, are also covered by the legal guarantee against hidden defects, under which the consumer has the choice between rescinding the sale or reducing the price in accordance with article 1644 of the French Civil Code.

Extracts from the Consumer Code and the Civil Code
Article L. 211-4 of the French Consumer Code: "The seller is required to deliver goods in conformity with the contract and is liable for any defects in conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when the latter was made his responsibility by the contract or was carried out under his responsibility."
Article L. 211-5 of the French Consumer Code: "To conform to the contract, the goods must: 1 - Be fit for the use usually expected of similar goods and, where applicable : - correspond to the description given by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model; - present the qualities that a buyer may legitimately expect having regard to public statements made by the seller, by the producer or by his representative, particularly in advertising or labelling; 2 - Or present the characteristics defined by mutual agreement between the parties or be fit for any special purpose sought by the buyer, brought to the attention of the seller and accepted by the latter. Article L. 211-12 of the French Consumer Code Any action resulting from a lack of conformity must be brought within two years of delivery of the goods
Article L211-16 of the French Consumer Code: "When the buyer asks the seller, during the course of the commercial warranty granted to him at the time of the purchase or repair of a movable good, for a repair covered by the warranty, any period of immobilization of at least seven days is added to the remaining warranty period. This period runs from the date of the buyer's request for service or from the date the item in question is made available for repair, if the item is made available after the request for service
Article 1641 of the French Civil Code: "The seller is liable for any hidden defects in the item sold which render it unsuitable for its intended use, or which reduce this use to such an extent that the buyer would not have purchased it, or would only have paid a lower price for it, if he had known of them

Did you know that reuse is the most virtuous loop in a circular economy? In fact, reuse helps to extend the life of products. Here is a non-exhaustive list of platforms where you can donate or resell your used products: LeBoncoin, Izidore, Geev, Emmaüs, Vinted, etc.

  • Recycling

If, unfortunately, your product cannot be recycled, you can drop it off free of charge at one of our collection points, which will ensure that it is recycled and does not end up in a landfill. To help you in this process, here is a list of some collection points:

When certain products are sold, we can take back your used products free of charge on request, depending on the quantity and type of product sold.

This free "1 for 1" trade-in, under the AGEC law, also aims to ensure the second life of used products, via donation or recycling.

It concerns products whose weight and/or dimensions exceed certain thresholds (i.e. a weight in excess of 30 kg or dimensions whose sum exceeds 2 metres - orThese thresholds to be confirmed by the authorities), for the product categories below:

  • Electrical and electronic equipment (EEE)
  • Chemical product contents and containers
  • Textile furnishings and decorations

What are the conditions for taking back a product ?

Heavy or bulky used products (weight > 30 kg or length+width+height > 2 meters) can be taken back at the point of delivery, within the limits of the quantity and type of new product purchased. The product taken back must be equivalent to the new product purchased, in terms of both its nature and its dimensions.

For example:

  • If you have ordered a table, ESPINOSA can take back your used table if you so request. However, you will not be able to take back your old washing machine.
  • If you have ordered a 2-seater sofa, you can have your old 2-seater sofa taken back, but you cannot have your old 3-seater sofa taken back if its dimensions and weight are greater than those of the new product purchased.

Please note that trade-in conditions vary according to the size and type of product. We therefore recommend that you contact us in advance of your purchase, to check the conditions relating to each product.

To return your old product:

  • The product must be disassembled and packed
  • The product must be deposited at the foot of the truck, near your home

The collection will not necessarily take place at the same time as the delivery of your order. It will be necessary to arrange a pick-up date different from the delivery date, so that the carrier can collect the goods from your home.

Who covers the trade-in costs?

Take-back is free of charge for the holder of the used product. ESPINOSA will bear the cost of taking back the product.

How do you take back your used product?

  • For used products whose weight and/or dimensions are below the above-mentioned thresholds, the used product will not be taken back at the point of delivery and may be dropped off by the customer at one of the above-mentioned local collection points.


  • For products whose weight and/or dimensions exceed the above-mentioned thresholds, you will be offered the option of collecting your new product from the place of delivery (e.g. your home). It will be necessary to arrange a date for the seller's carrier to collect the goods from your home.

Please note that your personal data may be passed on to the service provider responsible for collection at the point of delivery.
